www.banded-together.com (our "Website," or "Site") is owned by Banded Together Pty Ltd (“Banded Together" "BT" “we," “us,” and “our”). The following Terms of Service ("Terms") apply to all visitors or users ("you," "your," or "yours") of our Website and of our webpages (collectively, our “Services”). By using our Website, you agree to be bound by these Terms.
We reserve the right to modify the Terms at any time. Changes and clarifications will take effect immediately upon their posting on the Website. If you do not agree to any of these changes, you must discontinue using the Website.
PLACING AN ORDER AND PAYMENT
By completing an online order, You are making an offer to purchase the product at the price on our website.
Payment must be made at the time of submitting the online order. Payment can be made by Visa, MasterCard, Amex, Afterpay only. You warrant that you are an authorised user of the credit card, Afterpay account or PayPal account used to complete payment.
All online orders placed through this website are subject to confirmation and acceptance by Banded Together Pty Ltd. We will email you with confirmation of the receipt of your online order. Banded Together Pty Ltd may reject your online order for any reason and refund any payment made by you, at any time prior to dispatch.
The online order must be paid in full immediately upon entry into the Agreement. All transactions on the Australian website are settled in Australian Dollars (AUD). Customers purchasing from outside of Australia will have their currency automatically converted to Australian Dollars when you complete the transaction. The conversion rate varies from day to day with the current exchange rate. Many banks also charge a small currency conversion fee, contact your bank or credit provider for details.
Banded Together’s prices may vary in the event of price changes or mistakes on this website without prior notice to you.
PAYMENT GATEWAY
Banded Together processes all payments through Shopify Payments (SP). All purchasers must agree to authorise SP (on behalf of BT) to process the charge or charges on his/her credit card in the amount of the total purchase price for the merchandise which they purchase. You therefore authorise SP to perform credit checks to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions. We recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
Banded Together also offers AfterPay. If AfterPay is selected as a payment method than you must comply with AfterPay rules and regulations.
RETURN POLICY
All sales are subject to our Returns Policy. Returns can be processed via our Returns Portal.
DELIVERY
For all international orders, our products are shipped as DDU (Delivery Duty Unpaid). We are not responsible for any possible duties and taxes which may be applied by customs in the country where delivery is made. The responsibility for any custom duties, foreign taxes or other fees, which may be imposed, will rest with the customer. Please contact your local customs offices if you would like to seek more information regarding taxes and duties.
FAULTY POLICY
We aim to provide you with products of the highest standard and quality. If you have received a product with a manufacturing fault, please go to our returns portal and follow the prompts. If the product is confirmed to have a manufacturing fault, we will replace the product an d of this is not possible we will issue a credit note or refund the price of the product to your original payment method at your request. If the product is found not to have a defect or deemed out of warranty, we will ship the product back to you.
It does not constitute a defect, if in our reasonable opinion, the product has, following the sale to you, become of worse quality due to fair wear and tear, misuse or failure to use in accordance with care for instructions.

GIFT CARDS
Gift Cards are valid for three (3) years from the date of purchase. Gift Cards are not redeemable for cash. Unfortunately, Banded Together does not take responsibility for any lost or stolen Gift Cards. If an order is made using a gift card and is then cancelled or returned, the portion of the purchase attributable to the gift card will be refunded as a store credit only.
STORE CREDIT
Store credits are applied to the account registered with the same email address used to place your order. Store credits cannot be transferred to other accounts. Store credit is valid for three (3) years. Any balance that remains after the 3 years will not be available for use. Store credit does not accrue interest nor can it be redeemed or refunded for cash. If an order made using store credit is cancelled or returned, the portion of the purchase attributable to the store credit will be restored to your account only.
PROMOTIONAL CODES
Banded Together occasionally has special offers that can be applied to your order by using a promotional code. In order to take advantage of these promotions, you must enter the promotional code in the space provided during the checkout process and hit the "apply" button. The value of the promotion will be applied to your order automatically.
If you have not applied the promotional code but order was placed during the event contact our team straight after you’ve placed your order. It is up to banded Togerther’s discretion to refund you the discounted amount.
Please note, only one promotional code may be used per transaction and some are not valid with other promotions such as automatic spend and save offers. Unless otherwise specified each promotional code may only be used once per customer.
SPEND AND SAVE SALE
Cannot be used with other discount codes. Only items in the spend and save edit are included. Discount is automatically applied at the checkout. Purchases in the sale that have not been previously marked down can be exchanged for other items but not refunded as per our return and exchange policy (within 10 days of receipt of goods). Sale items that receive a further spend and save discount are final sale.
WELCOME CODES
Banded Together offers a welcome $50 off code on first purchases when signing up to our newsletter. To redeem the discount, apply the code at checkout. Discount is valid for 7 days from signing up.
WEBSITE SECURITY

SSL is a security device that ensures that any data, which you enter into a secure area of the website, is encrypted during transmission over the Internet. SSL utilises data encryption to create a secure environment for you to conduct your online transactions. In order for SSL to be effective, you must be using an SSL compliant browser.
Banded Together Pty Ltd does not store or keep credit card numbers from online transactions. The last four numbers and the expiry date of your credit card number are kept for order verification and identification purposes only. In the event a credit card is used without the holder's authorisation, the cardholder must notify their credit card provider in accordance with their reporting rules and procedures.
LIMITATION OF LIABILITY
Banded Together has provided information on this website as accurately as possible. We take all precautions possible to keep the details of your orders and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party acquires unauthorised access to any data you provide when accessing or ordering from the website.
To the extent permitted by law, all guarantees, warranties or representations which are not specifically stated in this Agreement are excluded. If banded Together Pty Ltd is liable for breach of an obligatory guarantee or implied warranty or representation, banded Together’s obligation is, at its option limited to the replacement of the products or the supply of equivalent products, the repair of the products or the payment of having the products replaced or repaired.
INTELLECTUAL PROPERTY
Banded Together Pty Ltd owns the intellectual property in its garment designs, fabric designs and images. Banded Together Pty Ltd forbids the use of its designs and images for any purpose without prior written consent from Banded Together Pty Ltd.
WEBSITE AVAILABILITY
On the rare occasion, http://banded-together.com could require some down-time, either scheduled or unscheduled. Banded Together Pty Ltd will try to ensure the amount of down-time is limited. Banded Together Pty Ltd will not be held liable for any consequences during down-time.
